TravelCenters of America Wage and Hour Lawsuit

Rita Mayo and Eva Dixon ("Plaintiffs") are former waitresses and servers who worked for TA Operating LLC at TravelCenters of America ("Defendant") They have sued in federal court in Cleveland, Ohio, alleging that Defendant failed to pay them minimum wage compensation for hours worked in one or more work weeks during their employment with Defendant. Specifically, Plaintiffs allege that Defendant paid its waitresses and servers an hourly wage, plus tips, but required them to report their tips based on a minimum percentage of their gross sales (typically 10%) rather than based on the actual tips received during their shifts. Plaintiffs allege that because their actual tips were frequently less than the minimum reporting requirement allegedly set by Defendant, this resulted in a minimum wage violation. As a result of these alleged practices, Plaintiffs maintain that Defendant violated the law.
