Texas does not have state laws regarding the payment of overtime wages. To learn more about wage and hour law in Texas, visit the website of the TX Workforce Commission.
Minimum wage law in Texas adopts the current federal minimum wage. Therefore, the current Texas minimum wage is $7.25 per hour.
Exempt employees under the federal wage and hour law, the Fair Labor Standards Act (FLSA), must be paid at least once per month. Employers who pay their workers twice per month must establish pay periods which contain nearly the same number of days. As long as employer meets these wage and hour provisions, he or she can designate any paydays they choose.
Employers must post a notice of paydays in conspicuous places in the workplace. If an employer does not establish set paydays, their employees must be paid on the first and 15th of every month. Employees who quit must be paid in full at the next regularly scheduled payday. Workers who are fired must be paid in full within six days. If a worker is not paid for any reason, including absence, he or she should be paid on another business day requested by the worker.
