Overtime Law in Oregon

Both federal and Oregon overtime laws govern the payment of overtime. Most employees should receive time-and-a-half compensation for hours worked in excess of 40 during a single workweek. Special rules apply to canneries, hospitals, government agencies and manufacturing companies. Minimum Wage in Oregon

The minimum wage in Oregon is $8.40 per hour, beginning Jan. 1, 2009. Oregon minimum wage law states that workers must receive at least the minimum wage throughout all stages of employment, including the training period.

Final Wages

Workers who quit with less than 48 hours notice: The worker's last paycheck is due within five days, not counting weekends or holidays, or on the next regualrly scheduled payday, whichever first occurs.

Workers who quit with at least 48 hours notice: The employee's final wages are due on the final day of employment, unless this day falls on a weekend or holiday. If a worker's last day lands on a weekend or holiday, he or she must be paid by the next business day.

Terminated employees: The final paycheck is due no later than the end of the next business day.

Mutual agreement to end the working relationship: The worker's final wages are due by the end of the next business day.

Employment related to state and county fairs: If the worker quits or is fired on a weekend or holiday, they must be paid by the end of the second business day following the separation.
