The Oklahoma minimum wage is $7.25 per hour, the same as the federal rate. Unless subject to the Fair Labor Standards Act (FLSA), Oklahoma employers must follow state minimum wage laws if the business employs at least 10 full-time workers and makes more than $100,000 per year.
Oklahoma does not have state-specific regulations regarding overtime. If a company is subject to the FLSA, non-exempt employees must receive time-and-a-half compensation for hours worked over 40 in a single workweek. For more information on overtime law in Oklahoma, visit the website of the OK Dept. of Labor.
With the exception of exempt workers, employees must receive their wages at least two times a month. Exempt, county, municipal and state employees must be paid at least once per month.
Final paychecks must be given by the next regularly scheduled payday, regardless of whether the separation was voluntary.
Employers are not required to offer breaks to workers ages 16 and older. Only workers under the age of 16, by law, are entitled to breaks. Offering meal or rest breaks is solely at the employer's discretion.
