
Under North Dakota Overtime Law, most employees should receive time-and-a-half compensation for hours worked in excess of 40 during a single workweek. The North Dakota minimum wage rests at $7.25 per hour, the same as the federal rate. North Dakota minimum wage law does not allow for the payment of training wages.
Separated employees must receive their last pay check by the next regularly scheduled payday, as if the termination had not occurred.
Employees working a shift of more than five hours must receive an uninterrupted, unpaid 30-minute meal break, as long as there are two or more workers on duty. Shorter breaks, such as 15-minute rest periods or coffee breaks, are not required but may be offered by the employer to increase productivity. However, if a break lasts less than 30 minutes the employee must be compensated for this time.
