
The minimum wage in Montana is $7.25, the same as the federal rate. It will remain at this rate at least until the end of 2010. Montana minimum wage law does not allow for training wages, tip credits or meal credits.
Most workers should receive overtime pay when working more than 40 hours in a 7-day workweek. Overtime pay is based on actual hours worked and does not take into account holiday, vacation or sick time. Overtime is 1.5 times the workers' regular rate. When a worker is laid off or fired, all wages are due within four hours or the end of the work day, whichever occurs first, unless a written company policy states otherwise. If a preexisting policy exists, payment of wages cannot be delayed beyond the next payday or 15 days, whichever comes first.
If an employee voluntarily leaves, wages must be paid on the next payday or within 15 days, whichever first occurs.
