Minimum Wage Law in Maryland

The current minimum wage in Maryland is $7.25 per hour. This is the same as the federal rate.

Overtime Law in Maryland

Maryland overtime law states that employees must receive 1.5 times their regular rate of pay for hours worked in excess of 40 in a seven-day week. Certain occupations may have different overtime "thresholds." For instance, farmworkers receive overtime pay for hours worked in excess of 60 in a single week.

Payment of Wages

Maryland employees must be paid at least twice a month or once every two weeks. Certain employees, such as executives employees, may be paid less often.

In general, an employer must establish regular pay days, and pay employees all wages due on these dates, regardless of whether the worker handed in a time card or quit without notice. Additionally, earned wages must be paid on time, regardless of whether the worker received payment from a client for a job on which the employee worked.

If payday falls on a weekend or holiday, payment must be made on the preceding workday.

Final Wages

Separated employees must be paid all wages due by the next regularly scheduled pay day on which he or she would have been paid if the separation had not occurred.

Employer Recordkeeping Requirements

Employers must keep a record for each employee with the following information: name; address; occupation; rate of pay; amount paid each pay period; hours worked per day and workweek. These records should be kept on site for a minimum of three years.
