Louisiana Wage and Hour Law

Louisiana does not have state-specific laws regarding minimum wage, overtime or the regulation of salaried workers. Louisiana employers must comply with the federal wage and hour law, the Fair Labor Standards Act.

Paycheck Deductions

Louisiana wage and hour law states employers cannot deduct wages as a penalty or fine, unless the employee damages the property. However, the deduction cannot exceed the actual damage done.

Final Wages

Separated employees must receive their final wages in full by the next regularly scheduled payday, not to exceed 15 days from the date of separation. Wages include vacation time earned by the employee. An employee should send a written demand for payment of their final wages to their employer. After receipt of a written demand, the employer must pay all wages owed to the employee on a timely basis or be subject to a penalty that may be imposed by a court. The Louisiana Workforce Commission does not have the power to enforce last paycheck laws, so employees may make a claim for their last paycheck through a private lawsuit.
