Overtime Law in Indiana

In general, federal wage and hour law and Indiana overtime law requires that employees be given overtime pay when working more than 40 hours in a single workweek. Indiana Minimum Wage Law and Covered Employers

Employers in Indiana employing two or more workers are covered by Indiana minimum wage and overtime law. Therefore, most Indiana employers and employees are covered by the minimum wage and overtime provisions of the federal Fair Labor Standards Act. Employers not covered by the FLSA may still be covered by minimum wage law in Indiana.

Minimum Wage in Indiana

The current minimum wage in Indiana is $7.25, the same as the federal rate. Employers who are not covered by federal minimum wage laws may still have to comply with state minimum wage law.

Indiana Minimum Wage: Tipped Employees

Tipped workers must receive at least the tipped minimum wage per hour. The employer is required to pay a base hourly wage of $2.13 an hour. If the employee is not paid at a rate equal to the minimum wage after adding any tips they received to the base hourly wage of $2.13 an hour, the employer must make up the difference. If the worker makes more than the minimum wage after adding the tips they received to the hourly wage of $2.13 an hour, the employer has fulfilled their obligation. A tipped worker can be defined as an employee who typically receives more than $30 per month in tips.

Final Wages

Last paychecks must be provided by the next regular pay day, as if the separation had not occurred.
