Overtime Law in Illinois

Workers are entitled to overtime compensation (1.5 times their regular rate) when working more than 40 hours in a single workweek. For more information on overtime law in Illinois, visit the Illinois Dept. of Labor.

Minimum Wage in Illinois

Workers who are 18 years or older must receive at least $8.00 per hour, the minimum wage in Illinois. Employees who do NOT receive tips may be paid $7.50 for the first 90 days with employer. Workers under the age of 18 may also be paid $7.50 per hour.

Illinois Minimum Wage: Tipped Workers

Tipped workers must receive at least the minimum wage per hour worked; however, the employer can take a tip credit, not to surpass 40% of the wages. An employer may pay a training wage for tipped employees 18 and over in the amount of $4.50 for the first 90 days if applying the tip credit of 40% or $7.50 if not utilizing the tip credit. After the initial 90 days of employment, the rate must be raised to $4.80 if using the tip credit of 40% or $8.00 if not using the tip credit.
